Kliksy Terms of Service
Version 2026-11-07. Effective 7 November 2026.
These Terms are a binding contract between you and EBOOK MEDIA LLC. Please read them carefully. Sections 16 to 20 limit our liability and, for business customers, require individual arbitration and waive class actions.
1. Who we are and what these Terms cover
1.1 Kliksy is operated by EBOOK MEDIA LLC, a limited liability company organized under the laws of the State of Wyoming, USA, with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801, USA. In these Terms, "Kliksy", "we", "us" and "our" mean EBOOK MEDIA LLC. You can reach us at ahoj@kliksy.sk.
1.2 "Service" means the Kliksy website, dashboard, application programming interfaces, the MCP connection for AI agents, hosting of pages, subdomains and custom domains, page databases, lead and analytics features, templates, documentation and every other feature we make available.
1.3 Your agreement with us consists of these Terms, the Acceptable Use Policy, the Data Processing Agreement and the plan, price and billing period you select at checkout. Together they form the "Agreement". Our Privacy Policy explains how we handle personal data and is provided for your information.
1.4 You accept the Agreement by ticking the acceptance box before checkout, by paying for the Service or by using the Service. If you do not agree, do not use the Service.
1.5 These Terms are published in Slovak and English. Both versions are binding. If they differ, the English version prevails for business customers, and the version more favourable to the consumer applies to consumers.
2. Business use only
2.1 Kliksy is a professional tool for entrepreneurs, sole traders, companies and people who are preparing to start a business. By accepting these Terms you confirm that you use the Service for purposes related to your trade, business, craft or profession and not as a consumer.
2.2 If, despite this confirmation, mandatory law treats you as a consumer, Section 10 applies to you and nothing in the Agreement limits the rights that mandatory consumer law gives you.
2.3 You must be at least 18 years old and able to enter into a binding contract. If you accept these Terms on behalf of a company or other organization, you confirm that you are authorized to bind it, and "you" then means that organization.
2.4 You may not use the Service if you are subject to sanctions administered by the United States, the European Union or the United Nations, or if you are located in a country or region subject to comprehensive sanctions.
3. The Service
3.1 Kliksy lets you publish and host web pages and sales funnels, connect your own domains, store data for your pages, collect leads, view analytics and connect your own AI agent so that it can create and publish pages for you.
3.2 Kliksy is a technical hosting tool. We do not create, review, approve, edit or monitor the content that you or your AI agent publish, and we are not a party to any transaction between you and your own customers, visitors or leads.
3.3 Kliksy does not provide any artificial intelligence model. Your AI agent, for example Claude, ChatGPT or Grok, is a third-party service that you choose and use under your own contract with its provider. Everything your AI agent does through your Kliksy access is treated as if you did it yourself. You are responsible for reviewing what your agent creates and publishes, for the permissions you grant it and for revoking access you no longer want it to have.
3.4 The Service has technical limits, including limits on pages, storage, file sizes, requests, database queries and data volume. We may enforce these limits automatically, slow down, reject or stop requests that exceed them and change them to protect the Service, other customers or our costs. Exceeding a limit is not a failure of the Service.
3.5 We continually change the Service. We may add, change, suspend or remove any feature, template, integration or limit at any time. Features marked as beta, preview, test or similar are provided for evaluation only, may be changed or withdrawn at any time and are provided without any warranty or commitment.
3.6 We do not promise any particular availability, uptime or response time. The Service may be interrupted for maintenance, updates, security measures, failures of our providers, attacks or events beyond our control.
4. Your account
4.1 You must give us accurate information and keep it up to date. Each login is personal. You are responsible for all activity in your account, including activity by anyone who accesses your e-mail inbox, your sign-in codes, your sessions or the access tokens of your AI agents.
4.2 Keep your access secure and tell us at ahoj@kliksy.sk without delay if you suspect unauthorized access. We are not liable for any loss caused by unauthorized use of your account that results from your failure to keep your access secure.
4.3 We may refuse to open an account, or close one, at our discretion, including where we suspect fraud, abuse or a breach of the Agreement.
5. Your content, your business and your customers
5.1 "Your Content" means everything that you, your team or your AI agent upload, create, publish or store through the Service, including pages, code, text, images, videos, forms, data, leads and settings. You keep ownership of Your Content.
5.2 You grant us a worldwide, non-exclusive, royalty-free license, for as long as we host Your Content and for the deletion periods described in our policies, to host, store, copy, cache, transmit, display, back up and technically adapt Your Content as needed to operate, secure and improve the Service and to comply with law.
5.3 You alone are responsible for Your Content and for your business. This includes your products and services, offers, prices, claims, testimonials, earnings or results claims, delivery, refunds, customer service, invoices, taxes, consumer protection, advertising and marketing law, intellectual property and licenses, the legal notices, terms and privacy policy on your pages, cookie banners and consent on your pages, and the consent you need for e-mail, SMS or other marketing.
5.4 You confirm that you have all rights, licenses and consents needed for Your Content and that Your Content and your use of the Service comply with the Agreement and all applicable laws.
5.5 If you connect your own payment provider, such as your own Stripe account, your relationship with that provider and with your buyers is yours alone. Kliksy is not a payment provider, merchant of record, marketplace or escrow agent and never handles your buyers' money. We are not liable for payments, refunds, chargebacks, disputes, fees, holds, reserves or closures of your payment account.
5.6 For personal data of your visitors, leads and customers that you collect through the Service, you are the controller and we act as your processor under the Data Processing Agreement.
5.7 You are responsible for keeping your own copies of Your Content. We make backups for our own operational purposes only and do not guarantee that any content can be restored.
6. Acceptable use
6.1 You must follow the Acceptable Use Policy. You may not use the Service for anything illegal, harmful, deceptive or abusive.
6.2 We may, without prior notice and without liability, remove or disable access to any content, page, domain or database, limit features, or suspend or close your account if we believe that you have breached the Agreement, that content is illegal or harmful, or that action is needed to protect the Service, other customers, third parties or us.
7. Domains
7.1 You may connect domains and subdomains that you own or control. You are responsible for registering and renewing them, for their DNS settings and for any effect that connecting them has on other services such as e-mail.
7.2 We are not liable for the loss, expiry, suspension or misconfiguration of a domain, for DNS propagation delays, or for interruptions of e-mail or other services on that domain.
7.3 Kliksy subdomains remain our property. We may change or withdraw them, and we never transfer them to you.
7.4 If domain registration becomes available through the Service, it is also subject to the terms of the domain registrar and the registry of the relevant domain.
8. Prices, payment and automatic renewal
8.1 Prices are shown in euros on the plan page before checkout. Where we must charge VAT, it is included in the price shown unless the checkout states otherwise. Business customers with a valid VAT identification number may be invoiced under the reverse charge mechanism.
8.2 You pay in advance for each billing period, monthly or yearly, through our payment provider Stripe.
8.3 Your subscription renews automatically at the end of each billing period for the same period and at the then current price, and you authorize us to charge your payment method on each renewal, until you cancel.
8.4 If a payment fails, Stripe may retry it. We may restrict paid features until payment succeeds and may suspend or close your account if it remains unpaid.
8.5 We may change prices with at least 30 days' notice by e-mail or in the dashboard. A new price applies from your next renewal after the notice period. If you do not agree, cancel before the renewal.
8.6 You pay all taxes, duties and charges related to your purchase, except taxes on our own income.
8.7 Invoices and receipts are available in the Stripe customer portal linked from your account.
8.8 If you dispute a valid charge with your bank or card issuer, we may suspend your account until the dispute is resolved and may recover the fees and costs that the dispute causes us.
9. Cancellation and refunds
9.1 You can cancel your subscription at any time in the billing portal linked from your account. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then.
9.2 Except where Section 10 or other mandatory law requires otherwise, payments are non-refundable. We do not refund partial periods, unused time, unused features, yearly plans cancelled early or downgrades.
9.3 After your subscription ends, we may stop serving your pages and restrict access to your account. We may delete Your Content 30 days after the subscription ends or the account is closed. Export anything you want to keep before then.
10. Consumers in the European Union
This Section applies only if mandatory law treats you as a consumer despite your confirmation in Section 2.
10.1 You may withdraw from the contract within 14 days of the day the contract was concluded, without giving any reason.
10.2 To withdraw, use the "Withdraw from the contract here" function in your account or send us a clear statement of your decision to ahoj@kliksy.sk. You may use the model withdrawal form at the end of these Terms, but you do not have to. Sending your statement before the period expires is sufficient.
10.3 If you withdraw, we will refund all payments received from you without undue delay and no later than 14 days after we receive your withdrawal, using the same payment method you used, unless you expressly agree otherwise. You will not incur any fees for the refund.
10.4 At checkout you expressly requested that we start providing the Service immediately. If you withdraw, you must therefore pay us an amount proportionate to the Service provided until you told us of your withdrawal, compared with the full coverage of the contract, and we deduct it from your refund.
10.5 You lose the right of withdrawal once the Service has been fully provided, because you requested immediate performance and acknowledged that you would lose the right after full performance.
10.6 Your statutory rights regarding the conformity of digital services remain unaffected.
10.7 For out-of-court resolution of a consumer dispute you may contact the alternative dispute resolution body in your country. In Slovakia this is the Slovak Trade Inspection, Slovenská obchodná inšpekcia, at www.soi.sk.
11. No guarantee of results
11.1 Kliksy is a tool. We do not promise that you will earn any money, make any sales, get any traffic, leads or customers, or achieve any business result. Any examples, case studies, templates, starter pages, prompts or figures are illustrations only. Your results depend on you, your offer, your market, your advertising and many factors outside our control.
11.2 Kliksy is not a business opportunity, franchise or investment, and we do not provide legal, tax, accounting, financial, marketing or other professional advice. Templates and sample content are not checked for legal compliance in your country or industry. Get your own professional advice.
12. Third-party services
12.1 The Service relies on and connects to services of third parties, including Cloudflare for hosting and storage, Stripe for payments, e-mail delivery providers, domain registrars, your AI agent provider and any integration you choose. Their services are governed by their own terms.
12.2 We are not responsible for third-party services, their availability, security, changes, prices, policies or acts, and we may stop supporting any of them at any time. Your use of a third-party service is at your own risk.
13. Our intellectual property
13.1 The Service, including its software, design, documentation, templates and the Kliksy name and logo, belongs to us or our licensors. We grant you, for the duration of your subscription, a limited, non-exclusive, non-transferable and revocable right to use the Service under the Agreement.
13.2 You may use the Service to build and host pages for your own business or for your clients, provided you remain fully responsible for those pages and clients as if they were your own.
13.3 You may not copy, modify, resell, sublicense or rent the Service itself, reverse engineer it except where the law expressly allows it, circumvent its limits or security, scrape it, or use it to build a competing service.
13.4 If you send us feedback or suggestions, we may use them freely without any obligation to you.
14. Reporting illegal content and content moderation
14.1 Anyone may notify us of content on the Service that they consider illegal or in breach of the Agreement by writing to ahoj@kliksy.sk. A notice should contain the exact web address of the content, an explanation of why it is illegal or in breach, the name and e-mail address of the person sending it, except for notices concerning child sexual abuse material, and a statement that the information is accurate and complete to the best of their knowledge.
14.2 We confirm receipt of a notice, review it with human judgment and decide on it in a timely, diligent and objective manner. We may use automated technical measures such as limits, rate controls and security filters, but content decisions are made by people.
14.3 If we remove or disable content, suspend or close an account or restrict features because of content, we tell the affected customer the reasons and the facts behind the decision, unless the law prevents us or the content is spam or a technical attack. You may contest a decision by replying to our message within six months, and you may also use any remedy available to you under law.
14.4 We may report information about suspected criminal offences that threaten the life or safety of persons to the competent authorities.
14.5 Copyright notices under the United States Digital Millennium Copyright Act may be sent to our designated agent as described in the Legal Notice. We terminate, in appropriate circumstances, the accounts of repeat infringers.
14.6 Our single point of contact for authorities and for users under the EU Digital Services Act is ahoj@kliksy.sk, in Slovak and English. Our legal representative in the European Union is named in the Legal Notice.
15. Suspension and termination
15.1 You may stop using the Service and cancel at any time under Section 9.
15.2 We may suspend or terminate your access to all or part of the Service immediately, with or without notice, if you breach the Agreement, fail to pay, give us false information, create risk or possible legal exposure for us, other customers or third parties, if a court or authority requires it, or if we suspect fraud or abuse.
15.3 We may also terminate the Agreement or discontinue the Service for any reason with 30 days' notice. In that case we refund the prepaid fees for any unused part of the billing period.
15.4 On termination your right to use the Service ends, unpaid fees become due and we may delete Your Content as described in Section 9.3. Sections that by their nature should survive termination, including Sections 5, 11 and 13 to 21, survive.
16. Disclaimer of warranties
16.1 To the fullest extent permitted by law, the Service is provided "as is" and "as available", with all faults and without any warranty. We disclaim all warranties and conditions, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, availability and uninterrupted or error-free operation.
16.2 We do not warrant that the Service will meet your requirements, that it will be compatible with your AI agent or other tools, that content will not be lost or corrupted, that your pages will comply with the laws that apply to your business, or that defects will be corrected.
17. Limitation of liability
17.1 To the fullest extent permitted by law, neither we nor our members, managers, affiliates, contractors or suppliers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, sales, business, goodwill, opportunity, data or content, advertising spend, cost of substitute services or business interruption, arising out of or related to the Agreement or the Service, however caused and even if we were advised of the possibility.
17.2 To the fullest extent permitted by law, our total liability for all claims arising out of or related to the Agreement or the Service is limited to the greater of the fees you paid us for the Service in the three months before the event giving rise to the first claim, or 50 euros.
17.3 Nothing in the Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud, for intentional misconduct, for gross negligence where the applicable law does not allow it to be limited, or any other liability that cannot be excluded or limited under applicable law. If you are a consumer, the limitations in this Section apply only to the extent mandatory consumer law permits.
17.4 These limitations are an essential part of the bargain between us and are reflected in our prices.
17.5 To the extent permitted by law, any claim against us must be brought within one year after the facts giving rise to the claim first occurred, after which it is barred.
18. Indemnification
18.1 You will defend, indemnify and hold harmless EBOOK MEDIA LLC, its members, managers, affiliates, employees, contractors and suppliers from and against all claims, demands, investigations, fines, penalties, damages, losses, costs and expenses, including reasonable legal fees, arising out of or related to Your Content, your pages, products, services, offers and marketing, your customers, visitors and leads, your processing of personal data, the actions of your AI agent, your use of the Service, your breach of the Agreement, or your violation of any law or of the rights of any third party.
18.2 We will notify you of a claim, you may control its defense with counsel reasonably acceptable to us, and you may not settle it in a way that imposes any obligation on us without our written consent. If you are a consumer, this Section applies only to the extent permitted by mandatory law.
19. Force majeure
19.1 We are not liable for any delay or failure caused by events beyond our reasonable control, including outages or failures of hosting, network, payment or other providers, cyber attacks, power failures, natural disasters, epidemics, war, terrorism, strikes, government actions or changes in law.
20. Governing law and disputes
20.1 For business customers, the Agreement is governed by the laws of the State of Wyoming and the federal laws of the United States, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
20.2 For business customers, before starting any proceeding you must first contact us at ahoj@kliksy.sk and try to resolve the dispute informally for 60 days. Any dispute that is not resolved will be finally settled by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, by one arbitrator, seated in Sheridan, Wyoming, in English. The arbitrator's award may be enforced in any competent court. Either party may seek urgent injunctive relief or protection of intellectual property in a competent court.
20.3 For business customers, all claims must be brought only in an individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding, and to the extent permitted by law each party waives any right to a jury trial.
20.4 If you are a consumer, Sections 20.2 and 20.3 do not apply to you. The choice of law in Section 20.1 does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence, and you may bring proceedings in the courts of that country.
21. General terms
21.1 Changes to these Terms. We may change the Agreement. We will tell you about material changes by e-mail or in the dashboard at least 30 days before they take effect, except for changes required by law or needed for security, which may take effect sooner. If you do not agree, you may cancel before the change takes effect, and if you are a consumer or the change is materially adverse to you, we refund the prepaid fees for the unused part of the billing period. If you continue to use the Service after the change takes effect, the changed Agreement applies.
21.2 Electronic communication. You agree that we may communicate with you, give notices and conclude the Agreement electronically. Notices to you are sent to the e-mail address of your account. Notices to us must be sent to ahoj@kliksy.sk.
21.3 Assignment. We may transfer the Agreement to an affiliate or to a successor in a merger, acquisition or sale of assets. You may not transfer it without our written consent.
21.4 Entire agreement. The Agreement is the entire agreement between you and us about the Service and replaces all earlier agreements, proposals and statements.
21.5 Severability. If any provision is held invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain in full effect.
21.6 No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
21.7 Independent parties. Nothing in the Agreement creates a partnership, joint venture, employment or agency relationship.
